Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Starve mobile application and related services (together, the "Service"). By installing or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. Who can use Starve
You must be at least 13 years old (or the minimum age required in your country) to use Starve. If you are between 13 and the age of legal majority where you live, you must have a parent or guardian's permission.
2. Your account
You are responsible for safeguarding access to your device and any credentials associated with the Service. You agree to provide accurate information and to keep it up to date. You're responsible for activity under your account.
3. Subscriptions and payments
- Billing: Starve Pro is offered as an auto-renewing subscription billed through your Apple ID.
- Renewal: Your subscription renews at the end of each period unless you cancel at least 24 hours before the end of the current period.
- Manage or cancel: Open Settings → [Your Name] → Subscriptions on your iPhone.
- Refunds: All purchases are handled by Apple. Refund requests are processed by Apple at reportaproblem.apple.com.
- Price changes: If we change subscription prices, we'll notify you in advance. Continued use after the change means you accept the new price.
4. Health disclaimer
Starve is not a medical device. Calorie and macro estimates are approximations generated by AI and are not a substitute for professional medical, nutritional, or dietary advice. Do not use Starve to diagnose, treat, or manage any medical condition. Consult a qualified healthcare provider before starting any diet, weight-loss, or nutrition program — especially if you have a history of disordered eating, diabetes, pregnancy, or other medical conditions.
5. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code from the Service, except as expressly permitted by law;
- Use the Service to violate any law or third-party right;
- Upload content that is illegal, infringing, or harmful;
- Interfere with or disrupt the Service or its infrastructure;
- Use the Service to build a competing product or to scrape or harvest data;
- Attempt to circumvent any usage limits, paywalls, or rate limits.
6. User content
You retain all rights to the content you submit to the Service (photos, voice notes, food entries — "User Content"). You grant us a limited, worldwide, non-exclusive, royalty-free license to host, process, and display your User Content solely to operate and improve the Service. We do not use User Content to train AI models for use with other customers.
7. Intellectual property
The Service, including its design, software, brand, and content (other than User Content), is owned by Starve and protected by copyright, trademark, and other laws. You may not copy, modify, or create derivative works without our written permission.
8. Third-party services
The Service may integrate with third-party services (e.g., Apple Health, Apple's App Store, our AI inference provider). Your use of those services is governed by their own terms. We're not responsible for the practices of third parties.
9. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use poses risk to the Service or other users. Sections that by their nature should survive termination (e.g., disclaimers, limitations of liability) will survive.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted, error-free, or that food recognition results will be accurate.
11. Limitation of liability
To the maximum extent permitted by law, Starve and its officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for loss of profits, data, or goodwill arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $50.
12. Indemnification
You agree to indemnify and hold Starve harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your User Content, your violation of these Terms, or your violation of any law or third-party right.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Delaware, except where mandatory consumer-protection law gives you the right to bring a claim in your country of residence.
14. Apple-specific terms
If you obtained the App from the Apple App Store, the following also applies: these Terms are between you and Starve, not Apple. Apple is not responsible for the App or its content. Apple is a third-party beneficiary of these Terms and may enforce them against you. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
15. Changes to these Terms
We may update these Terms from time to time. If changes are material, we'll provide notice (e.g., in-app or by email). Continued use of the Service after the effective date constitutes acceptance.
