End User License Agreement

This End User License Agreement ("EULA") is between you and Starve and governs your use of the Starve mobile application ("the App"). By downloading, installing, or using the App, you agree to be bound by this EULA. This EULA supplements our Terms of Service and Privacy Policy.
1. License grant
Subject to your compliance with this EULA, Starve grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions.
2. Restrictions
You agree not to, and not to permit others to:
- License, sell, rent, lease, transfer, or assign the App;
- Modify, copy, or create derivative works of the App;
- Reverse engineer, decompile, or disassemble the App, except as permitted by law;
- Remove or alter any proprietary notices in the App;
- Use the App in any way that violates applicable law.
3. Apple-specific provisions
You acknowledge that this EULA is between you and Starve only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. The following terms apply when you use the App:
- Scope of license: The license granted is limited to a non-transferable license to use the App on any Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Maintenance and support: Starve is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance and support services.
- Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a warranty failure are the sole responsibility of Starve.
- Product claims: Starve, not Apple, is responsible for addressing any claims by you or a third party relating to the App, including product-liability claims, claims that the App fails to conform to legal requirements, and claims arising under consumer-protection or similar legislation.
- Intellectual property: In the event of a third-party claim that the App or your use of it infringes that third party's intellectual property rights, Starve, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Legal compliance: You represent that (i) you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary: You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and that Apple has the right (and is deemed to have accepted the right) to enforce this EULA against you.
4. Subscriptions
Some features of the App require a paid subscription. Subscriptions are processed by Apple and governed by Apple's Media Services Terms. See the Terms of Service for details on billing, renewal, and cancellation.
5. Privacy
Your use of the App is also subject to our Privacy Policy, which explains how we collect, use, and safeguard your information.
6. Termination
This EULA is effective until terminated. Your rights under this EULA terminate automatically if you fail to comply with any of its terms. Upon termination, you must stop using the App and delete it from your devices.
7. Disclaimer of warranties
The App is provided "as is" and "as available," with all faults and without warranty of any kind. To the maximum extent permitted by law, Starve disclaims all warranties, whether express, implied, statutory, or otherwise.
8. Limitation of liability
To the maximum extent permitted by law, in no event will Starve be liable for personal injury or any incidental, special, indirect, or consequential damages whatsoever arising out of or related to your use of or inability to use the App.
9. Governing law
This EULA is governed by the laws of the State of Delaware, USA, excluding its conflict-of-laws rules. The U.N. Convention on Contracts for the International Sale of Goods does not apply.
